The Walmart truck driver accused in the deadly New Jersey Turnpike wreck that critically injured comic Tracy Morgan early Saturday had not slept "for a period in excess of 24 hours" before the crash, the criminal complaint released Monday says.
Kevin Roper, 35, had a Monday court appearance in Middlesex County Superior Court in New Jersey postponed to Wednesday.
The complaint drawn up by New Jersey State Police charges the Jonesboro, Ga., man with vehicular homicide and assault by auto in the Saturday morning wreck. Roper was driving a 2011 Peterbilt truck for Walmart when he apparently failed to notice traffic slowing down ahead. He swerved to avoid a crash and slammed into Morgan's Mercedes limousine bus, causing it to flip and slide into other vehicles.
James (Jimmy Mack) McNair was killed, while Morgan suffered a broken leg, broken nose and several broken ribs. The "30 Rock" actor will be laid up in the hospital for several weeks, his publicist said Sunday.
His assistant, Jeffrey Millea and comedian Ardie Fuqua Jr. were also critically hurt. Harris Stanton, another comic aboard the limo bus, escaped with only a broken wrist.
The National Transportation Safety Board said Sunday it would work with Garden State cops to investigate any issues in the crash related to commercial trucking and limousine safety.
